Terms & Conditions***ATTENTION DEUTSCHER DESIGN CUSTOMER ***IMPORTANT NOTICE SHOWN BELOW THAT APPLIES TO ALL SALESNOTE: Due to the fact that we publicize this policy page with intentions for this information to be read by our customers prior to placing an order makes all orders are subject to the terms and conditions regardless to whether the customer submits a agreement form or not!Thank you for your assistance!Please review our order policy found below prior to placing a custom orderWhen placing a custom order with Deutscher Design, you as the purchaser agree to all terms and conditions regarding your custom purchaseTerms and conditions apply regardless to whether the policy is read by the purchaser or not. Our policies are implemented as a safety mechanism to deter fraudulent purchases and to ensure that our customers enjoy a safe and informed shopping experience. There are NO exceptions to this policy.We appreciate your cooperation as we do our part to protect the interests of our customers as well as our own. Courtesy and professionalism are very important to us and we like to expect the same from our customers, We reserve the right to cancel orders and or restrict sales due to breach of prior agreed service agreements, issues of conflict, threats or suspicious activity as well as where we believe the reputation of Deutscher Design could be brought into disrepute and therefore we reserve the right to respond to all acts of defamation against our company to the fullest extent of the law. **************Buyer Seller Policy/Order Terms AgreementOur, We, Us refers to the Seller and any Company listed as/or under Deutscher Design You, refers to the Purchaser, Buyer or Recipient*****E-Mail CorrespondenceYour e-mail correspondence is very important to us and we want to be sure that we reply to all mail received within 48 hrs. However since the internet is not infallable we can not always consider the delivery of your e-mail to be 100% reliable Therefore if you don't hear from us within 48 hrs please resend your e-mail request to be sure we can assist you at once Cancellation PolicyAll of our items are custom items made to your specifications - therefore the order cannot be canceled once the payment is collected.For all custom orders over $200.00 a non-refundable deposit is required. The deposit will be at least 50% of the total cost of your custom order which covers any special design service, assistance in locating desired materials, the purchase of all materials needed in order to complete the custom order. The remaining balance will be due before your order is shipped Exceptions only are made IF we notify you that your fabric is on back order. In case of a material back order you may wait for your fabric to arrive or you may allow us to help you select a new fabric or you may select to receive a refund. All Fabrics are purchased from various on line vendors who have their own return policy which may be different from our policy, however defective fabric will be replaced.*****Change Of Purchased Item PolicyChange of order requests may be made within 48 hours of placing your order No changes may be accepted after 48 hours or once your custom order went into production *****Delivery & Lead timeAll custom orders are completed on a first come, first serve basis and will be put on our schedule once the purchase order is placed and all materials necessary in order to make the custom item are received by Deutscher Design Average lead time can be expected to be around 25 business days However this lead time can be subject to change depending on the actual receipt of your approved purchase order as well as the receipt of the required payment and or deposit. We urge all customers to submit all requested information when placing your custom order. Failure to submit important specifications i.e. size of your custom home decor item, fabric & fabric colors, the receipt of any COM materials as well as any information on additional added accessory items and their colors needed in order to complete your item could cause significant delays in completing your custom order. Additional delays due to revisions & changed design approvals can also occur when ordering custom products. Quoted delivery dates are approximate - Therefore Deutscher Design shall not be responsible for any delays caused by either the customers failure to submit any requested and important information needed to complete the custom order, as well as for failure in performance for any course beyond our control including, but not limited to strikes, lockouts or other labor difficulties, failure or delay of sources to supply, transportation difficulties, accidents, fires, Acts of God or any event which interferes with Deutscher Design's normal business and manufacturing operations.*****Return Policy** ALL SALES ARE FINAL **All of our products are custom made according to Your specifications therefore all Custom made items are NON - Refundable If something seems incorrect you should contact us within 7 days of receiving your order and we will make every effort to correct it to your satisfaction. We want all of our customers to be excited about their custom home decor therefore our goal is always 100% customer satisfaction*****Shipping PoliciesMajority of all items will be shipped via USPS Parcel Post, unless a special shipping service request is made by the customerIf you the customer requests a special shipping services additional shipping fee's may apply.You may contact us to have a separate invoice sent to you to cover additional shipping costs. All packages shipped via USPS include tracking information for packages shipped with U.S destinations. It is your responsibility to stay aware of where your package may be during times of postal service processing and delivery. A shipment notification is automatically generated and sent to the customers email address when the order has been scheduled for delivery. We advise all customers to contact us if they have not received their package within ten days after the package was scheduled to be delivered. This schedule does not include weekends nor national holidays.*****Shipping InsuranceWe do not provide shipping insurance for orders. Customers may request Insurance or Signature Confirmation at their own discretion. These services are optional and must be paid by the customer.Charges for Insurance or Signature Confirmation will be charged upon request. These services MUST be requested by contacting us prior to shipment. If you - the customer fails to purchase insurance for covering lost items, damaged items, or mis- delivered items, by completing any and all sales transactions with our company, you agree that we will NOT be held liable nor responsible for refunds nor replacements. *****Chargeback PolicyChargeback fraud has become one of the leading causes of losses for Internet based businesses around the world. It is a form of theft that inevitably causes a rise in prices for the average consumer and contributes to the need for additional security measures that may be bothersome for those who do not have dishonest intentions. A chargeback occurs when a customer contacts their credit card issuing bank to initiate a refund for a purchase or a custom order deposit they made on their credit card. Furthermore initiating a charge back with your credit card company with the intent to receive a refund for a NON-REFUNDABLE deposit will cause additional delays due to the fact that we will not release the completed custom order until all payments are made in full as initially agreedHowever we like to achieve 100% customer satisfaction and understand that perhaps a possible breakdown in communication or a simple misunderstanding could have caused a customer to initiate a credit card charge back in either cases we are more then happy to release part of the completed custom order once we receive notice that the credit card charge back has been canceled.The remaining custom items will be shipped once we receive the outstanding balance including any any additional shipping charges or fees that occur due to filling the credit card charge back.Since chargebacks are costly and can add a considerable amount to our operating costs, which ultimately affects our ability to provide the best prices to our valuable customers, we will not tolerate chargeback abuses.ALL customers who file chargeback claims with the intent of circumventing our policy will be reported to the Chargeback Protection Project and other legitimate online merchant protection agencies which may affect the buyers ability to purchase from any other online retailers within the United States as well as other participating countries. In ALL cases, where a customer has filed a fraudulent chargeback claim with the intentions of circumventing our policy, due to changing their mind, not reading sales promotions, non compliance with shipping policy, or no longer wishing to receive the product for any reason, we will file a formal customer complaint and report with IFCC (Internet Fraud Complaint Center) during the initial stage of our resolution process. In all cases where the chargeback is clearly fraudulent (such as item not received claims or claims the item to be damaged upon arrival) and with ill intent, we will file a report with the customer local law enforcement authorities. If the product was delivered via U.S. Mail we will also file a mail fraud complaint with the Postmaster and federal authorities. If in case a fraudulent chargeback claim results in the funds used to purchase items from Deutscher Design being refunded back to the buyers account by their credit card issuer, we will immediately attempt to be reimbursed directly from the buyer.*****Reconciliation Regarding Payment Transaction Reversal and Chargeback FraudAs the customer you are fully responsible for paying all monies owed to Deutsher Design for custom items ordered. In respect of any payment made by you, you agree that you will not make any chargebacks, and/or deny or reverse any such payment and will reimburse our company for any charge-backs, denial or reversal of payments and any loss suffered by our company as a consequence of your actions or those of your credit card issuer. In the event that payment of a shipped order is reversed by you or your credit card issuer, you are responsible for making payment to Deutscher Design immediately. Payment is due within 24 hours of any reversal. Any past due amount will accrue a penalty of $3.00 per day until payment is made in full. Delinquent accounts over 60 days are turned over to a collection agency for which additional charges that include collection agency fees, attorney fees, court fees and other applicable fees will be assessed and will apply according to any violated terms within our policy. By placing an order on our website you as the buyer are fully aware that you are engaging in a buyer/seller transaction for goods for which payment is due prior to shipment of your custom order. As the customer, you are hereby informed that if payment is not made according to the above mentioned terms, your name, address, and any other identifying information discovered in our investigation by way of public record sources will be used to collect any outstanding funds via a collection agency. *****Defective Product or Not As Described ClaimsWe advise that customers inquire about specific details prior to placing an order. All items are tripled checked by Deutscher Design prior to shipment to insure that the custom item and the packaging is not defective. As a security measure, Deutscher Design photographs all custom items as well as all packages prior to shipment. This information is retained in our individual customer files as a method of proof in regard to probable damaged upon arrival claims. In case a package is damaged during shipment the customer/buyer must file a complaint within 24 hours of receiving the package and leave all items and packaging in the manner in which they received it. Instructions for sending the package back to us will be provided to the customer. Any shipping fees for sending the package back to our facility are the responsibility of the customer.A full investigation with results and a final decision will be made by Deutscher Design and correspondence will be sent to the email address used for placing the order within ten days. If at any time, we believe that a claim has been filed for custom items that used or tampered with while in the custody of the customer we will not send replacements.** There are NO exceptions to this policy **Deutscher Design may update its Policy's from time to time.
